1. Acceptance of Terms

By registering, purchasing, or using any proxy services on proxyudp.com, you automatically agree to these Terms. If you do not agree, do not use the Service.

2. Services

We provide SOCKS5 (UDP) proxy services ("Service") on an “as‑is” and “as‑available” basis. We do not guarantee uninterrupted service, specific speeds, or performance.

3. Eligibility & Permitted Use

Open to individuals and business (B2B) clients. Use only for lawful purposes and in compliance with applicable U.S., EU, and Spanish laws.

4. Acceptable Use Policy & Prohibited Conduct

By using ProxyUDP services, you agree not to:

4.1. Illegal Activities

• Engage in fraud, phishing, hacking, DDoS, malware distribution, or other criminal offences.
• Violate copyrights, intellectual property, or commit piracy.
• Access restricted systems (e.g., financial, government networks).

4.2. Security Violations

• Probe, scan, breach or interfere with any system you do not own or have permission for :contentReference[oaicite:2]{index=2}.
• Forge headers or misrepresent packet origins.

4.3. Network Abuse

• Engage in spam, unsolicited mass messaging.
• Flood, swamp, or create network disruptions (e.g., mail bombing, broadcast attacks).

4.4. Malicious Content

• Transmit malware such as viruses, worms, trojans, spyware.
• Share content that is obscene, hateful, defaming, harassing, or violently threatening.

5. Child Safety

No content involving minors in sexual or illegal situations.

6. No Evasion of Restrictions

Do not use proxies to bypass third-party usage limits or geographic restrictions.

7. Enforcement

Violations may result in account suspension or termination without refund.

5. Monitoring & Termination

We do not proactively scan accounts, but upon receiving legitimate complaints, we may:

• Investigate, suspend, or terminate your account.
• Provide no refunds in those cases.
• Disclose logs to authorities if required by valid legal order.

6. Fees, Payments & Refunds

Payments accepted in EUR, USD, and cryptocurrency. All purchases are final—no refunds, partial or pro‑rated. Dispute claims are subject to binding arbitration.

7. Log Collection & GDPR Compliance

We collect the following logs:

• Client IP address
• Timestamp
• Destination IP

Retention period: up to 30 days (standard best practice is 30–90 days) :contentReference[oaicite:6]{index=6}. Logs are deleted or anonymized after expiration. Longer retention only if legally required.

8. Legal Compliance

We comply with valid legal requests or court orders from U.S. or EU law enforcement.

9. Indemnification

You agree to defend, indemnify, and hold ProxyUDP and affiliates harmless from any claims, damages, or expenses arising from your use or misuse of the Service.

10. Disclaimer & Limitation of Liability

Service is provided “as-is” with no warranties. Our maximum liability is limited to the lesser of: (a) total fees paid by you in the last 6 months, or (b) €500. We are not liable for indirect, incidental, or consequential damages.

11. Intellectual Property

All trademarks, software, and content on proxyudp.com are owned by us. No rights are transferred.

12. Modifications

We may update these Terms at any time. Changes will be communicated via the website or email. Continued use after notice constitutes acceptance.

13. Governing Law & Dispute Resolution

These Terms are governed by Spanish/EU and U.S. law. All disputes are resolved exclusively through binding arbitration under UNCITRAL rules. Arbitration will take place in Madrid for EU matters, or a mutually agreed venue in the U.S. for U.S. matters.

14. Severability

If a provision is deemed unlawful or unenforceable, the remainder of the Terms remains in full effect.

15. Account Responsibility & Resale

Resale or sharing of proxies is permitted. You are fully responsible for all activity under your account credentials. Notify us immediately of any unauthorized use.
